The notion of a court case can be extremely scary to some individuals, and as a result they might not seek a lawyer about their personal injury claims. However, there are a few ways that a personal injury case can proceed without taking the case before a judge in a courtroom. Often times lawyers are able to sit down and negotiate a deal for their clients that makes both the plaintiff (you) and the defendant happy. Personal injury attorneys will figure out a sum of money that will cover expenses for the claim, and if both parties are happy with that amount, the case will be settled. Sometimes, this step needs to go a bit further, and a mediator who is neutral is brought in. This person facilitates the negotiations and helps to move the talks along. In the event a settlement is not reached either by your personal injury attorney or through a mediator, your case may need to go to court. Your personal injury attorney will be able to tell you how they believe your case will proceed.
