November 24, 2006, Newsletter Issue #28: What is Medical Malpractice?

Tip of the Week

Medical malpractice is a term that defines any wrongdoing by medical staff, whether it is intentional or neglectful. Of course, this means that the term covers a lot of ground. If a doctor fails to diagnose a patient correctly, it is malpractice. If a doctor performs an incorrect or otherwise imperfect procedure or surgery, this is also medical malpractice. It is also malpractice if a doctor or other medical personnel does anything to breach your trust, or that goes against the practices that are considered legal in your state. If you feel a doctor has done something that would be considered medical malpractice, you may need to consult a medical malpractice attorney in order to find out what your rights as a patient are.
